ESOS Phase 3 Compliance Deadline Extended to 5 June 2024

The ESOS phase 3 compliance deadline extended by six months to 5 June 2024 to provide organisations with more time to meet the updated requirements.
What’s new in ESOS Phase 3?
Following consultation with the Department of Energy Security and Net Zero, the Environment Agency announced the introduction of new ESOS phase 3 requirements. These changes will affect all current
ESOS applications as well as new applications.
Organisations that qualify for ESOS in phase 3 will be required to comply with the new requirements when they come into force. To ensure there’s reasonable time for participants to comply, participants in phase 3 will be allowed until 5 June 2024 to provide a notification of compliance (previously 5 December 2023).
Qualification criteria remains the same
Although the compliance date has been extended, the qualification thresholds and date remain unchanged.
Any company or group that met the criteria as a large company for ESOS on December 31, 2022 (employing at least 250 people, or with an annual turnover over £44 million and a balance sheet total over £38 million) are still required to comply with ESOS phase 3.

Failure to comply with ESOS regulations can lead to:
- Fixed penalties of up to £50,000
- Additional penalties of £500 for each working day until the breach is remedied
- Being listed as non-compliant on the government website
